Bayern Munich’s Lucas Hernandez sees prison term suspended by Madrid court

Bayern Munich star Lucas Hernandez avoids jail for disobeying a restraining order he received for assaulting his wife as last-ditch appeal sees his six-month sentence suspended by court

  • The Bayern Munich defender was given a restraining order in February 2017 
  • Hernandez was sentenced to 31 days’ community service for assaulting his then girlfriend and now wife Amelia Ossa Llorente 
  • He was arrested in June 2017 for defying the restraining order after landing in Madrid along with his wife following their marriage and honeymoon 
  • Hernandez originally received a six-month jail sentence earlier this month 
  • His sentence has now been suspended for four years by a Madrid court 


Bayern Munich star Lucas Hernandez has avoided a prison sentence after seeing his appeal upheld by a Madrid court. 

The French international had been given a six-month prison term for disobeying a restraining order following a 2017 conviction of domestic violence against his then girlfriend and soon to be wife Amelia Ossa Llorente.  

Hernandez appealed the decision and was given until midnight on Thursday, October 28, to enter prison voluntarily.

But as reported by ESPN, Section 26 of Madrid’s provincial court ruled on Wednesday that the sentence has been suspended.

The sentence has been suspended for four years as long as the 25-year-old does not commit a new offence during that time and also includes a €96,000 fine (£72,000).

‘Regarding his family and social circumstances, it has been highlighted in the appeal that the convicted person lives with Mrs. de la Osa and their son, without any new incidents between them being recorded,’ court documents said.

While Hernandez has two previous convictions, court documents added that a sentence can be suspended ‘when looking at the personal circumstances of the inmate, the nature of the fact, their conduct and, in particular, the effort to repair the damage caused’.

Hernandez was sentenced to 31 days’ community service for assaulting his then girlfriend in February 2017, when he was an Atletico Madrid player, and was given a restraining order preventing him from being within 500 metres of her. She was also sentenced to 31 days community service. 

They later married and Hernandez was arrested for violating the restraining order when flying back to Spain from their honeymoon in June of that year.

Hernandez made his professional debut for Atletico in 2014, joining Bayern in 2019 for £67million. He has made 29 appearances for France, winning the 2018 World Cup and the 2021 UEFA Nations League trophy.
